Halcyon Lodge prevails in court case brought against them by Grand Lodge of Ohio

This is post number 1,000 on The Burning Taper. What a long, strange trip it's been.

Just in time for Christmas there's a reason for the brothers of Halcyon Lodge in Cleveland, Ohio to celebrate. Earlier today the following was posted on the Clerk of Courts website for Cuyahoga County.

DEFENDANTS' MOTIONS FOR SUMMARY JUDGMENT ARE GRANTED IN PART AND DENIED IN PART. SUMMARY JUDGMENT IS GRANTED IN FULL AS TO NON-OFFICERS MICHAEL HOWARD, JOEL MICHALEK, CHRISTOPHER MICHALEK, TOME COSTE, HALCYON CHARITIES. SUMMARY JUDGMENT IS GRANTED IN PART AS TO DEFENDANT OFFICERS CHRIS SNOW, TODD WARMINGTON, LYNN ERIC CHIPPS, SCOTT KELLY. ONLY ISSUE THAT REMAINS FOR TRIAL IS RETURN OF "PERSONAL PROPERTY MASONIC IN NATURE AND UNPAID DUES." ALL OTHER CLAIMS FAIL. DEFENDANTS OWED NO FIDUCIARY DUTY TO GRAND LODGE AND DEFENDANTS ACTED IN GOOD FAITH TO PRESERVE ASSETS OF LODGE. THE COURT FINDS THAT THE VOTE TO TRANSFER ASSETS WAS DONE IN ACCORDANCE WITH BYLAWS. FINALLY, THE COURT CONCLUDES THAT BYLAW 9.01 IS NOT APPLICABLE AS "ANY OTHER SUCH POLICY OF TEMPLE OWNERSHIP *** SUBMITTED TO TEMPLE COMMITTEE" AS THE ACTION WAS NOT FINANCING OR CREATING INDEBTEDNESS. PRE-TRIAL SET FOR 01/12/2010 AT 02:45 PM. PRETRIAL SET TO SCHEDULE ADDITONAL COURT DATES INCLUDING TRIAL DATE. CLPAL 12/22/2009 NOTICE ISSUED

According to the court's ruling, the brothers of Halcyon Lodge acted in accordance with the Masonic bylaws and in good faith.

Frank Haas, Halcyon Lodge honored as outstanding Masons of 2007

The Knights of Freemasonry Universal, a group of regular Freemasons from around the world dedicated to peace, universality, and "'true' Masonic tolerance," announced earlier this week their international awards for outstanding Masons of 2007.

Past Grand Master of West Virginia M.W. Bro. Frank Haas, who was expelled late last year by the current Grand Master, was among the recipients.

Our brothers at Halcyon Lodge in Cleveland, Ohio were honored with a group award for "putting the 'free' back into Freemasonry."

The Knights of Freemasonry Universal's news release follows:
INTERNATIONAL AWARDS ANNOUNCED

Alexandria, VA. February 9, 2008: Today the Knights of Freemasonry Universal announced the following recognition awards for outstanding Masons of 2007.

In keeping with the organization's mission to promote, educate, and research Universality in Freemasonry, those here recognized have taken courageous steps to promote brotherhood and understanding within the Masonic Fraternity. Each will hold the Title of Knight Zuri, the word Zuri being Swahili for good and beautiful.

The new honorees are:
  • Brother Jeff Ballou, of Washington D.C. (USA), for his tireless efforts in bringing the Afro-American and Caucasian Grand Lodges together in D.C.

  • Brother Jack Buta of Arizona (USA), for his research into the Politics of Masonic Foreign Relations. [Link]

  • Brother Frank Haas, PGM, West Virginia (USA), for his efforts in bringing enlightenment to the craft.

We all shine on: Tom Coste

W. Bro. Tom Coste, of Cleveland's Halcyon Lodge, writes in to tell us "This is Who I Am." Thanks, Bro. Tom!

Greetings, Brethren!

I bring salutations from the North Coast of America. I was raised to the sublime degree of a Master Mason in Sept on '01. By June of '02, I had entered the Order of Knight Templar, which meant that I had received the Royal Arch degree's between November and March, then traveled to Pennsylvania to receive the first two degrees in Cryptic masonry; select master and royal master in one day, where Pennsylvania and Ohio companions put on the first two degrees. It was a beautiful experience to take part in the first two council degrees in such a manner. I then received the final degree of Council and then it was off the Commandery. In amongst all the York Rite degree's, Ohio, in '02, held their first one day class. My Lodge brought in 12 men in that first one day class, and I mentored a couple of guys for this, and at the end of the MM Degree, the Scottish Rite conferred the 32nd degree for all Master Masons who wanted it, then off to the Shrine to become a Shriner.

So, by June of '02, my daughter was born, my father had gone through 4+ surgeries (I live next door to my parents; my father is wheelchair-bound from his surgeries), I was sitting in the JD seat, I was a Knight Templar, a 32nd Degree and a Shriner! Wow!

I also got roped into a Masonic Bowling League that met every Wed as well.

So, I had Blue Lodge every Thursday, bowling every Wed, Shrine 1 Monday a month, Chapter 2 Friday's a month, council 1 Monday a month, Commandery 1 Tues a month and learn officer material for Blue Lodge. Oh, yeah, and run and operate a family business that is open 24 hours a day, 7 days a week!

By December of '04, I was installed as Worshipful Master of my Lodge. I donated time and product to various Masonic bodies and functions. I was known and accepted in all the Masonic circles. When I was inspected as Master, we were inspected in the Master Mason degree. We had over 100 masons present, a PMWGM and many Past and Present DDGM's were in attendance. I did the whole degree from beginning to end, played King Solomon and then handed the Lecture off to our Lecturer. We had a huge dinner, a retirement party for our DDGM John Whitehouse and a standing ovation for our Fellow Craft Team. It was the highlight of my Masonic experience thus far.

Since retiring from the East, I have joined another Blue Lodge that was lacking Masonic experience and education, so I dove into helping any way I could in the development of this Lodge. I tried to instill some tradition and focus on masonry that I had learned in my fast travels through the masonic bodies. It was a joy to be involved in the instruction and the raising of young men with no Masonic history. At this Lodge, none of us had Masonic lineage, so our ideals of masonry were fresh and new. We were open to new things and had the initiative to bring the Lodge forward into the 21st Century. It was a hard task that also involved the rehabbing of the Temple that was left to ruin. So, the revitalization of a Lodge and a Temple was another satisfying experience with Brothers all on the same page with a common goal.

A common desire and goal amongst a group of men can accomplish many things. Even things that seemed impossible to some others can be possible to the right, motivated group of men and Masons. Plus, the young men of this Lodge were not racists or bigots, whereby initiating men of all colors and faiths into their Lodge, before it was really practiced. The young men were also excited about associating with the Prince Halls in our area. We attended many of their rituals and they helped out with ours. The Prince Hall Masons were some of the most polished Masons and took Brotherhood to another level.

With my new involvement in this Lodge, I focused all my time and energies into this, and dropped my associations with the Scottish Rite (it was a bunch of bad plays to me and no real further Light), dropped out of the Shrine (bad management and too much backstabbing amongst Brothers), dropped out of Commandery due to differences in integrity. I also do not believe that "Christian Orders" serve a place in Freemasonry.

I dropped out of Council because it was basically in need of rehabbing in my area and I had no energy for that. I loved their degrees, but believe that this material and the Royal Arch should be Educational Material for Blue Lodge instead of Title-bearing bodies. I dropped my involvement in my other Blue Lodge due to a resistance in helping Brothers in need at my other Blue Lodge. The brothers at my second Blue Lodge were having troubles and reached out to my original Blue Lodge for help and counsel, but were turned down and that really bothered me that masons and men would turn their backs on Brothers in need? It was not a difficult decision for me, especially when I was approached by a Past Master who warned me that my Masonic Career would be in "jeopardy" if I continued to get involved in this other Lodge's issues.

First, I did not join masonry for a career; second, I did not join masonry to turn a blind eye to potential shenanigans. Then, by the small threat of not getting into the Royal Order of Jesters (alluding to my Masonic Career) that operates out of the Shrine, I was more determined to get to the bottom of this situation and not be deterred, especially if it has Masons trying to discourage me from getting involved. I am glad I did get involved, because myself and a group of young, industrious Freemasons saved a Lodge and a Temple from being discarded into a rubbish heap. A ton of hard work, education and fortitude carried us onward in the face of perceived, intentional subterfuge by the leaders of our area. Without any outside help from our Brothers in the area, we battled for our rights and stood our ground on the principles of right and seem to have landed on our feet, for now.

The future looks bright, especially when one opens the Doors of the Temple to finally allow Light into it! We are going to make a difference in the community and it is exciting to actually have a plan on how to go about it. By helping the community to raise its consciousness level about "all of mankind" and how important the exposure to the Arts and Sciences are for the less privileged youth in your community, we can all transmute ourselves into higher evolved beings, which will make the environment in which the Temple resides one of education and enlightenment for all; not just the Masons who reside within the Temple. And that, my Brothers, is hopefully the application of Freemasonry upon your environment.

Halcyon Lodge releases letter to former Halcyon Lodge No. 498 members

Ken Miller, Master of Halcyon Lodge and former Master of Halcyon Lodge No. 498 (no longer extant), released this afternoon a letter addressed to the former members of the former Halcyon Lodge No. 498, explaining the details of the lodge's surrender of their charter to the Grand Lodge of Ohio.

Dear Brother __________,

We write to inform you of recent events concerning Halcyon 498. Our lodge has been at odds with the Grand Lodge of Ohio for several months on a number of important issues. Chief among those have been the Grand Lodge of Ohio's attempt to control the content of our website, its unwarranted demand that we shut down our website, its attempt to dictate whom we may or may not associate with, and most recently their attempt to coerce the lodge to reverse a transaction that has been tremendously beneficial to the lodge, the West Side Masonic Temple, and to the community.

The transaction in question is the gift of financial assets and West Side Masonic Temple Company shares in December of last year to Halcyon Charities, an Ohio
non-profit corporation that was founded by several brothers working with community leaders.

There were very good business reasons for making the gift. Before this transaction, the Lodge was losing money every year as it was forced to bear all of the building expenses on its own. Furthermore, after years of neglect by previous management the building is sorely in need of expensive repairs. It became clear to the brethren that if Halcyon 498 were to continue acting as the sole source of revenue to support the building, the lodge would slowly bleed to death over the next few years. The end result would have been the end of the Temple and the death of Halcyon 498. The brethren determined that this was an unacceptable result. Thus, the Lodge unanimously voted that it would no longer fund the West Side Masonic Temple Company.

To insure the long term preservation of the building AND the long term viability of
Halcyon 498, the lodge voted unanimously to gift its securities, including its shares
in the WSMTC, to Halcyon Charities. Halcyon Charities is not a temple company, but is instead a fully functioning public charity as defined by the Internal Revenue Code. Thus, it has the ability to pursue strategies to generate revenue through rentals and through charitable activities that will ultimately lead to tax-deductible donations. It can engage in fund raising to support its charitable programs, and to support building maintenance and operations. Further, its public charity status will position it to seek a local property tax exemption, which (if granted) will significantly improve the bottom line. It is clearly a superior business structure for the long-term viability of the temple.

Halcyon Charities has two goals: serving poor and underprivileged youth, and historic preservation of the building. Halcyon Charities seeks to establish athletic and arts programs to serve children in its neighborhood and the surrounding Cleveland area. It has already established a reputable youth boxing program that is housed in the building. Halcyon Charities is actively seeking strategic partners to establish a youth arts program utilizing the building's theatrical stages. The charity has already contributed significant value to building, including finishing the ballroom to return it to rentable condition, repairing the neglected air handling systems, repairing the roof, and building the boxing gym to house the boxing program. In short, it is doing what the brethren of the lodge hoped it would do when they voted to make the gift.

This transaction was also designed to insure the long term viability of the Lodge.
Without the burden of supporting all building expenses, the Lodge was suddenly solvent and its anticipated dues revenue exceeded its expenses. In just a few years,
the end result would have been a healthy lodge meeting in a safe and healthy building, and enjoying a much higher profile in the community in the process.

Unfortunately the Grand Lodge of Ohio lacks the vision and understanding to
appreciate what the brethren of Halcyon have done. At this year's annual meeting,
several DDGM's and high ranking officers of Grand Lodge made an unannounced visit to our Lodge. MWB Steven Krekus, in the presence of Grand Treasurer MWB Thomas H. Galyen, the current Junior Grand Warden, RWB Bradford Goebel, and all 5 current 22nd District Deputy Grand Masters, read a letter from the Grand Master demanding that Halcyon #498 reverse the transaction and put things back to the way they were — and giving the lodge only 48 hours to comply. The Grand Master stated that if the Lodge did not comply, he [would] remove the duly elected worshipful master and secretary of Halcyon Lodge #498 and assume control of the lodge. After reading the letter, brothers Krekus, Galyen and Goebel immediately left the building offering no opportunity for discussion.

It was both legally and practically impossible for the lodge to comply with this
order. Further, the Lodge determined that it was inappropriate to allow the Grand
Lodge officers to overrule valid elections and remove/replace officers without the
consent of the lodge. Given the 48 hour deadline, the lodge felt that it had to act
immediately to prevent this obvious injustice. Thus, the lodge unanimously voted
to surrender its charter, severing its relationship with Ohio Grand Lodge.

Those present at the meeting were concerned about what would happen to brothers who may want to remain Masons in good standing within the Ohio Grand Lodge system. DDGM Edgar Phelps confirmed that all brothers who had not surrendered their dues cards would remain in good standing and would be permitted to affiliate with another blue lodge. Thus, the good standing of the brethren of Halcyon Lodge #498 is unaffected by this move — your dues card is still valid and you are still a Master Mason in good standing with the Grand Lodge of Ohio. However, upon surrendering the Charter, Halcyon 498 ceased to exist.

It is regrettable that this all happened so quickly, but the unexpected and illegal
mandate by the Grand Lodge left Halcyon Lodge with little choice. We are mindful that many of you have already paid your dues for the coming year, and you will now have to affiliate with a new lodge and pay its dues, if you choose to remain a Mason within the Ohio Grand Lodge system. Thus, it is our intention to provide a full refund to all brothers who have paid their 2008 dues. At this point we will not cash any additional dues checks. If your check has not been cashed yet, you wil get your check back with your dues card. If your check has already been cashed, we will write you a refund check. We wil try to get to everyone, but if you do not receive a refund check within the next 4 weeks, please send us a letter at the address below to the attention of Mike Howard. Note that we have already paid the per diem to Grand Lodge of Ohio, so you are in good standing and should have no problems affiliating with another blue lodge.

Many former members of Halcyon 498 have turned in their dues card and formed a new lodge that is not affiliated with the Grand Lodge of Ohio.
